Aug 08: In a much awaited decision regarding Centre’s plea to vacate the stay on the implementation of 27 % OBC quota has been refused by the Supreme Court. This has turn to be a disappointment for the central government.

Supreme Court was not satisfied with the advocacy given by centre and the entire move to get the implementation of 27% quota in central educational institution failed. Central government was ready to keep “creamy layer” out of the reservation quota if it gets nodding from the Supreme Court to implement the reservation from current year itself.

The proposed reservation for OBC attracted strong reaction from all over India. Argument opens with questioning of the implementation of quota before a five judge constitution bench headed by Chief Justice K.G Balakrishnan. The anti quota petitioner also raises question on Centre’s decision to increase the seats so that it will not harm general category.

Against Medical Council of India which advocates of 4:1 ratio of student and teacher, Centre’s plea is not justified with the appropriate data and measure it will take to increase the infrastructure. The bench also reacted on the report of oral direction given to the institutions to prepare before hand for the implementation of OBC quota.

It was a setback for the government, but the bench’s justification of the Government being too haste without quantifiable data seems to take poor cognizance of the issue of preparedness for the implementation.

The Supreme Court has also rejected the plan of central government to increase the seats in engineering and medical colleges to neutralize the negative effect of reservation on the students of general category saying the court can not pass any interim order and held its earlier order as it is.

The decision has again stirred the issue which shook the nation few month back, sure not a respite for Human Resource Minister Arjun Singh who wanted to push quota regime to all centrally funded institute.
