Court stays criminal case against ESPN for overcharging
New Delhi, Nov 25 (IANS) The Delhi High Court Tuesday stayed criminal proceedings against sports broadcaster ESPN India for not complying with a telecom regulator's direction against overcharging for the direct-to-home (DTH) service.
Justice Rekha Sharma stayed the criminal proceedings after ESPN assured the court that it would comply with the regulator's direction within two days.
The criminal complaint was filed against the channel by Telecom Regulatory Association of India (TRAI) after ESPN refused to comply with its direction. ESPN said the tariff charged from DTH providers should be 50 percent of charges levied on cable operators in areas where set-top boxes were not used.
ESPN approached the court after the Telecom Disputes Settlement and Appellate Tribunal (TDSAT) refused to stay the proceedings in a city court here.
However, it restrained the TRAI from taking any coercive measures for cancellation of its down linking license.
