Retd Army officer to face court martial

A retired Lieutenant General, the second highest in Indian Army hierarchy, S K Sahni will be court-martialled on Nov 26, facing corruption charges for allegedly procuring poor quality food materials for troops combating insurgency in Jammu and Kashmir in 2005.


A senior official, divulging the decision in New Delhi on Friday, said that the Army has decided to initiate court martial proceedings against S K Sahni. The court martial proceedings will start on 26th of this month at the 11 Corps headquarters in Jalandhar.

After the matter came into light, a court of inquiry instituted in 2005 in Jalandhar (Punjab) to unearth the truth found enough evidence against Sahni— the then director general of Army Service Corps and Transport, to prosecute him for alleged irregularities in the supply of dry meat for the troops stationed in Jammu and Kashmir, a senior army official said this to IANS on the condition of anonymity.

A year later in 2006 he retired from the Army, a court martial was proposed against him in the case, but could not be implemented then, as the court stayed the proceedings after Sahni had approached to court, seeking exemption from Army inquiry. The court sought all the evidences against Sahni, and later allowed the court of inquiry to carry on proceedings.

The court of inquiry found Sahni accused along with six other officers comprising a major general and two brigadiers, and now has ordered the court marital of the retd. lieutenant general on Nov 26.

According to the Army Act, army courts can try personnel—retired or serving—for all kinds of offences, committed during their service tenure, except for murder and rape of a civilian, which are primarily tried by a civilian court.
