Gurgaon hit-and-run bus driver now booked for culpable homicide

Gurgaon, April 25 (IANS) A state team of forensic experts Friday reconstructed the accident scene and collected evidences from the spot in Sector 47 after a driver of the city bus was booked for running over a doctor and his small daughter Monday.

A four-member team of experts from the Forensic Science Laboratory (FSL), Madhuban, Karnal, headed by additional director, physics, Friday visited the accident spot where cardiologist Pankaj Gupta, 45, and his five-year-old daughter Lineshiya were run over by a city bus while they were waiting for the child's school bus.

"We have collected blood samples, hair with flesh and a part of skull from the spot (in front of Rail Vihar Apartments gate) and blood stains and pieces of flesh from the bus that mowed down the duo," a team member told IANS.

"We have now booked bus driver Harish Singh, 32, of Haryana's Jhajjar district under Section 304 part II (culpable homicide not amounting to murder), a non-bailable offence, and have informed the court," Police Commissioner Alok Mittal told IANS.

"The change was made on technical ground and not under any pressure. We examined the case properly and decided to impose stringent section of Indian Penal Code (IPC)," he said, adding the driver will be rearrested soon.

Answering a question, he said no one from the Indian Medical Association (IMA) met him or contacted him for stringent action in the case.

Earlier, driver Harish Singh was booked under IPC for rash driving (279), death due to negligence (304 A) and causing damage to property (427), and was granted bail by the court within hours of the accident as the sections imposed were bailable.

If the person booked under Section 304-II is proved guilty, he can get up to 10 years in jail, fine or both. Under 304 A, the maximum punishment is two years.

Gupta was working at the Medanta Medicity Hospital here as a cardiologist, while Lineshiya was a nursery class student at the Delhi Public School here.

Gupta's wife Jyoti, who was a few metres away from her husband with her eight-month-old daughter, fainted and was admitted to the Medicity Hospital.
