Google-owned Motorola Mobility abuses German position, files patent injunction on Apple

London, May 7 (ANI): In yet another patent dispute, Google-owned Motorola Mobility has reportedly abused its position in the German mobile market by not allowing Apple to enter in a fair and non-discriminatory agreement.

Motorola won an injunction over Apple products for the use of patents in February 2012 but the two companies could not arrive on a price to be paid by Apple, resulting in the removal of Apple products from its German website, reports BBC.

According to the report, the dispute surrounds the standard essential patents (SEPs), which are necessary for the operation of standards like the mobile phone signal. The current dispute about Motorola's innovative SEPs is crucial to the data transmission of GPRS in GPS cellular services worldwide.

For any SEP holder it is important to provide the use of patents to the competitors in return for a fair price. Apple had to make six offers before being declared a willing licensee.

Despite Apple's willingness to enter a fair and non-discriminatory agreement, Motorola is misusing the intellectual property right, which it holds on the data transmission patent.(ANI)
