RBI issues fresh guidelines over recovery issues

Dec 01:  Banks should adopt legal path for all sorts of debt recovery and should be more transparent in terms of distributing loans, said RBI in a press release yesterday. The RBI has received several complaints from public as per using muscle power and rude behaviour used by recovery agents.

The Reserve Bank of India, RBI on Friday issued a draft guidelines for all private and public sector banks under ‘Mid-Term Review of the Annual Policy for the year 2007- 08’ to check the complaints receiving from the public regarding ‘rude’ behaviour of recovery agents engaged by banks for collecting the debts from the defaulters.

RBI has directed the banks to prefer legal actions against the bank’s defaulter and not to hire local goons for recovering the debts. The India’s Central Bank has also suggested to all banks to run proper training program for all their recovery agents like issuance companies do and to use the ‘Lok Adalats’ for recovery of personal, credit card and housing loans if the loan amount is less than Rs. 10 lakh.

“The number of litigation of banks engaging recovery agents was on the rise in the recent past. It was felt that adverse publicity might result in serious reputation risk not only for the bank concerned but also for the banking sector as a whole”, said RBI in a written statement.

“An urgent need was, therefore, arisen to review the policy, practice and procedure involved in engagement of recovery agents by banks in India. Reserve Bank has, in this background, proposed to issue operational guidelines for adoption by all commercial banks.”, said RBI.

RBI has also asked to Non-Banking Financial Companies (NBFCs) to follow the similar guidelines issued. The Apex bank has appealed to the public to post their views as per these norms within one month via, posting letters, email, fax and phone. The rectified guidelines will be imposed on the banks after government’s approval.

Reserve Bank has also said that the temporary ban could also be imposed over the banks for violating these regulations and it could also be permanent if the violation became frequently as per RBI stated.

If India’s upper courts (High Court and Supreme Court) find out any complaint and slap any penalties or pass any restriction against any bank, RBI would take supervisory action against the bank or its directors or officers or agents with regard to policy, practice and procedure related to the recovery process.

For providing proper training, the banking regulator has asked Indian Banks’ Association (IBA) to develop a one-year certificate course along with Indian Institute of Banking and Finance (IIBF), for training direct sales agents, marketing agents and recovery agents. All the recovery agents engaged with any bank would also have to undergo in the certificate training program conducted and awarded by IIBF as per banking regulatory informed.

Banks are advised not to use the muscle power or any uncivilised manner to the defaulters for colleting the debt. Banks or recovery agents can also neither use unidentified telephones (The banks have to provide the phone numbers to the customer at the time of borrowing that would use for reminding the debt.) nor can go to the borrower’s house in the odd hours for asking the debt.

If banks hire the service of any recovery agency, the agents of the service agency will have to go for proper training and the banks and the recovery agency will also have to follow all the guidelines strictly.

For recovering their debts, bank can take into possession defaulter’s property but only through legal means, which can be soled through auction for getting the repayment. However, banks will also have to send a notice period to the defaulter before repossession and entire procedure for selling and auctioning.

RBI has also suggested to banks of having a due-diligence mechanism for hiring recovery agents that can be used to address the behaviour of the recovery agents and the register the complaint made by the borrowers.

RBI assumes that after strictly imposing these guidelines, the banks will be demoralised as per ‘distributing’ retail loans. Now most of the banks have clogged giving small range personal loans of Rs 25,000 to the lower end of the segment. On the other hand, the banks have to provide the complete detailed list of engaged recovery agencies or agents including bank’s staff to the clients.

In terms of these guidelines, banks were advised that in the matter of recovery of loans (a) The lenders should not resort to undue harassment viz. persistently bothering the borrowers at odd hours, use of muscle power for recovery of loans, etc. (b) The banks should ensure that agents engaged by them for debt collection refrain from action/s that could damage the integrity and reputation of the bank (c) Their agents should not resort to intimidation or harassment of any kind, either verbal or physical, against any person in their debt collection efforts, including acts intended to humiliate publicly or intrude into the privacy of the borrowers'/ credit card holders' family members, referees and friends, making threatening and anonymous calls or making false and misleading representations.

sir my mother has taken housing loan from hdfc housing she is regularly paying the emi but due to heartattack she is no more & there is no one liable to pay the rest amount we have asked for ots they are saying that we dont do any ots and the principle is only Rs75000 & the interest they have charged is Rs249000 so what can we do in it plz reply sir

I am been harressed by recovery agents appointed by HDFC personal loan, I took a personal loan and due to certain unavoidable circumstances could not repay few EMI and now again startedre paying the same though bank has already charged me add on interest but still I am been regularly harressed by recovery agents
My family is been abused by them against code of conduct set by RBI they keep on calling even in late night waking us up
Though I have sent a written complaint to HDFC bank stating the details of repaying my loan where in I did receive a mailer from customer care HDFC stating that recovery agent shall no more boather me but still as they are hevealy incentivised hence keep on harrssing us

Toady I spoke to your CSR's by name Chethan, Arpan and the supervisour Hiren ie on 14th November 08 at 4.00 PM. And I really pitty your recruitment of agents and the training u ppl give. Mr. Chethan diconnected my call for no reason or coz I asked him questions which he couldn't answer and placed the notes that I used profanity. Is this what you teach ur agents to maintain your AHT. Coming to Hiren even he was not proffesional enough to be a sup to take escalation calls. I am totally upset with ur service wat I got from u ppl today. Here is what I want from you as an answer. I dont vow u ppl any money and my card is blocked due to delay in payment, so I want a confirmation on this that can this be activated or not, so that I can take this to higher levels and I cant let you ppl go being so disgraceful on customers.I promise I would not let anyone use ur service of your bank henceforth and make ppl close all kinds of relationship they have with ur company. I know I cant do it every customer of yours but a few would surely effect to ur cmpny. And please await a letter from RBI and by my Lawyer and I would shortly meet your rep in Consumer Court and lets see there hoe it goes.

My name is Rupesh.N, and i'm so frustrated with ur bank feel like throwing u people out of India and not allow you to have any services here.
I have a credit card with u guyz and made the payment on 9th August 2008 and u people are so quick it got updated in ur systems on 22nd August 2008. From there my headache started with u guyz and its been completing 2 months the card is still not activated and I am fed up calling u people and that bloody customer care no what you have is charging me and its not a toll free number and the last guy whom i spoke gave me this mail id and told u people can do something.
So here is the final word if its not getting activated i break this CC and advise my friends and collegues not to use ur services it could be CC or PL. And look guys i have received my recent statements till u guyz revert back to me on this and activate ill hold the payment and probally register a complaint in Reserve Bank of India and to the Head Off in UK.
So guyz its ur turn to take some actions on this.

Hi My Name is Umesh this person Vignesh called me for the recovery .I had only taken 8000/- they are telling that i had taken 12800 rs where as the limit is only for 12000/- since my salary is on 7th of every month i could not pay at the correct time then also i paid about 33000/- they still want me to pay 32000 which is my outstanding .They abuse me & my dad as lower class fellows i have recorded each & every msg .I have been telleing them for installement wise payment they said i have no option for that .I stopped paying for the same for one month .They say that they will hand over the file to sone tug agency . i have no other option left so i have to file a police case regarding the same .Pls let me know if you can help me with this .

on Oct12,2008 a icici bank person name 'KIRAN' has come to my house without prior intimation, which as per RBI guidelines its a crime under article RBI / 2005-06 / 211
DBOD.FSD.BC. 49/ 24.01.011/ 2005-06
and he spoke to me rudly. Same day a person with a name rajiv had called me from # 022-41021621 and i informed him that i have already spoken to nisha on Sept14,08 for setelment.
But no action was taken on it when i informed 'RAJIVE' about this he started speeaking in very foul language, not only that he also abused me & threatend me for my life & my family members
even today (14/10/08) tellicaller named 'JYOTI' called up my house and abused my wife & threatend her stating they will make our life misserable.

This was not sufficient so they called up in my ofice and abused my co-ordianter ( Receptionist ) and later caled my Reporting manager in a very abusive way. I visted Bank bank c/c off at andheri east twice for setellment but i am not getting proper response......


Would Be requiring an immediate action on this matter or else will left with no option but going forward for Police complain as i have every conversation recorded..

Looking forward for response.

Me and my family have recently been harassed by HDFC credit card recovery people and tele-callers.
We are not aware of the actions that can be taken against them as per RBI guidelines.
The total outstanding payment was Rs. 45000 last month because of which we were called beggars and fraud.
They called at odd hours, abused me and spoke to us in a harsh way.
I want to settle down my dues and want to go for a negotiation (get a waive-off). I have contacted the customer-care
and have complained against the caller,but as such I am getting no response.
The said even if they settle the amount they wont give me NOC and would give my name in CIVIL. I don't understand this.
What should I do in this situation, where should i contact.
Please do suggest me how should I apply for settlement and what are the guidelines. I want a NOC after i pay the settlement amount.

hai,this is srihari from hyderabad,ihave taken excavator on instalments,ihave paid upto 80 per of the loan money ,iwas having arrers of 20 per by the time of the clouser of loan,the recovry men with out any notice they tried to lift the excavator and the excavator got fell down when they were trying to load it into trailer,from ther the recovery men flew away ,leaving the excavtor in site itself,now the bank people are making me to make rounds to there bank by saying today we are going to settle it,for the past 4months.now they are saying that they are going to write off the loan amount and the intrest,but the damage to the excavator is more than the loan amount,hope u suggest me as soon as possible.thanking u sri hari.

pls help me, i am confused..wht to do? i am harrased by recovery agents. my husband is having 3 credit cards of icici bank, since 5 years he was paying all payments on reguler basis. but las 2 months he is unable to make payment of his crdit card outstanding. he is jobless since 6 months, but we managed to make payment by selling my all ornaments, but nw we are totally broke and i am facing financial crunches. we have intimated to recover agent tht we wont be able to make payment for 2-3 months. las one month i m facing mentally harrasment from recovery agents of icici bank. they threatened my mother-in-law and me that they will kill my husband and will take me with them..and also they will seal my house to recover their money. they are saying that they are icici employees, bt when i asked them their id,, they refused to show that. even they give dhamki tht we will bit you husband as he is from Uttar Pradesh. becous of all this harrasement, i m suffering from mental stress, and feeling like to do suiside. and i wil do like this...for tht the icici bank will be responsible.

HI All, my name is Amit & having Barclay credit card, as there was a disaster situation last year i had to leave my house in pune because it was a part of road widening hecne i had to arrenge for the shelter for my family & i took home loan & for that i had to swipe the card for 31000 full limit as i took money from my friend & freind did the shopping on it, now i really have nothing to pay & i am not paying to bank only 1050/- i have paid till date, due to very bad economical situation i requested the bank managers & recovery agents to give me some more time i will surely pay whole amount. I am actually feeling guilty now that i coudnt pay anything to barclays bank but request you to kindly help me & suggest me some way out of this as I am currently not even earning 8000 per month. Bank is giving me 5 to 10 calls per day & recovery agents are doing harrasment by visiting at house every day, now its not my mothers fault its my fault so why should bank harras my mother & wife, bcause of this shocking behaviour by bank my mother is now addmitted in the hospital to undergo a surgery, for that also i dont have money to pay the hospital billed, kindly let me no how can i fire a case against the bank & recovery agency because its now getting worse day by day, if anything happened to my mom who will be resposible for that?
i did not wanted the credit card at all but contineously 1 week bank agent irritated me & forced me to take the card I always refused to take but daily they used to give me a call & say that sir please take the card sont use it just keep but take the card, now if i have been forced to take the card & when i was in a very criticle situation when i didnt had some other option i made use of the card limit & anybody couldhave done the same thing in that condition.

Hi am using a barclay credit card and i have not made the payment for more than 5 month due to some miss comunication by an executive name Robert who called me for payment and it was a mumbai number and infrmed to pay 6300/- rs which i payed however the next month still i got a call claiming to make a payment of 13500/- rs as due. then i receive call from Harun the collection manager and he asked me to pay 900/- rs and the rest amount will be adjusted as i was wrongli charger every month i am receiving call & SMS from the bank and every time i am asking them i want to close my card and give me a letter stating the what is my total amout due whic i will make the payment and then close the card still no responce. from last three days i am receiving calls between 2.30am to 3.30am for payments.

I own a HDFC card since 2006, I met with an road accident resulted loosing my job, family position is very bad, inspite of that I have been paying as much as possible, But for last twice I got call from HDFC recovery cell then sent a person and and lady on phone humiliated and threatened me of dire consequences if I don't pay the money, I somehow arraged the money and paid, yesterday when I was in Moolchand Hospital a lady from HDFC recovery cell (no 66093312), used humiliating, insulting words, abused in english and asked me to pay Rs. apprx 4500/- and again threatened me to send goondas at my house on sunday. My mother is sufferring from cancer, she refused to take any treatment till I sort out this issue from HDFC. In order to satisfy her I lodged a complaint with cutomer care no 08248090712. Customer care executive though noted my complaint but told me that recovery cell may send and take their course of action, we are helpless. Now I may be please told when I had 2 years long relations with HDFC, has my isurance policy of Rs.60,000/- to HDFC, then Rs. 4500/- I will be harrassed and my old parents who have no business in this case why, why are they being tortured of mental agony. I request you to please take strong steps against the recovery cell, I won't mind if my issurance deposit with HDFC is adjusted.

i,tushti shyamal divetia, have availed personal loan from your bank. currenently it is top up by your side after seeing good repayment record and in that also 11 months have passed. since last 6-7 months i am facing financial crunches in bussiness due to world wide inflation and because of that i have become irregualr in payment. currently there is 2 months emi due with your bank including this month, i had commited to pay by 29th but i could not manage by that date, i am receiving calls from your collection agents from delhi using very bad word on my family and also they call at my residance and talk in same manner with my parents who are senior citizens.....specially Mr. Amit. i will pay with in some day and if your bank thinks that i have commited default then firstly they should intimate in writting which till date you have not done, i am being threatend on phone and being absued by your executive, which i had gone to your Parimal Garden Brance, Ahmedabad and had talked with lobby manager and i had made her hear the words which Mr. Amit had used while asking money, this is totally illigal abd out of procedure. kindly take action against same and reply me with in 7 working days, if i dont get any positive reply for this then i will be forced to file legal complaint against the said executive and the Bank.

As you all know without knowing much about the interest details, these guys make us come to their office and with honey suckled tongue they give all the promises. This was what happened to me around 3 years while I received the loan from these crooks.

I paid the loan for 32 months. Las 4 months i had genuine problems. I explained and told the guys that I would certainly make the payment in full in two months. I did send a registered letter to all their offices. They kept quiet. Meanwhile they demanded twice the amount I owed and gave fantastic reasons. I did bargain and made the payment. This was in 6th Feb 2008.

I got a letter on the spot that the settlement has been made under special circumstances and i would be receiving the NOC shortly.

Guys, I do not understand the word "Shortly".

When you owe an EMI these guys rush in and make a hue and cry for the payment. But when you have paid the amount till last paise, they do not care to send the NOC. They are least bothered.

(June 2008) Meanwhile I had to go in for an Education loan. I applied in a Bank and waited for the outcome. They said due to the unsettled Personal loan with GE Money the loan has been rejected.

I rushed to GE Money and they calmly said that "Yes. You did not pay the EMIs and hence we had to report to CIBIL."

I requested them for the NOC. After various requests and visits they finally gave the NOC. I do not know how many times I visited their Branch, how many times I called them, how many time I sent an email to them, how many times I sent letters to them...

I also called CIBIL and found that GE Money had sent my name and other details to be published as a defaulter.

CIBIL people told that unless they get a letter from GE Money they would not be able to update the details. Till such time my name would show as a defaulter whenever any financial institution checks if I apply for any loan.

Even today (29th Aug 2008 - 4.30 pm) I had sent an email to GE Money, asking them to send the updation to CIBIL. They have not sent any updation for the last SIX months it seems.

What the Hell it is? Having paid the amount due to them, its like calling myself as a defaulter till they wish to update. Its ridiculous.

I am going to take LEGAL action against GE Money if my loan details are not updated within a week, thats what i have said in the mail. And I am planning to do so.

Kindly do give me any feedback and suggestions if any.

Hello,I'm running a transport company,n have a query regarding a finance company's rights regarding seizeing n charging various expenses for the same.
One of my trucks met with an accident n could not pay the installments.The finance co then seized my truck n asks for the payment of the entire loan amount for the truck.,though we are ready to pay the outstanding amt.till date.They also charge us heavily on seizing,parking,cheque return charges,etc.Kindly guide me as how much max.they can charge us for the same n help us get our truck back.Plz mail me ur answer at the earliest.Thankyou.

I am holding a cerdit card of Barclays bank & and having a outsatnding payment to be made to the bank Rs.77,000.,from that i have paid three day before rs.5000 & have asked them to give time to pay more amount & but known his recovery agent always call or coming home at any time or any day & forcing to give the payment on the spot, after requetsing then also he is not listening any thing& calling very day 6/8 time a day.,what should i do for the same pls give the solution for the same.

i have taken a Credit Card from HDFC BANK which is almost close to 2years old,when i've got my card i found that my billing address was wrong ,then i will call to bank & correct that.
after few month my card was over limit i was unable to made a payment before due date,due to time clashing with my job. then their excutives calld me up after due date & asked for payments & genunily i made my payments to their excutives when they came.they are also charging finance & late fee charges which are very high. i told to bank to deduct some chrges because i have already made more than my outstanding but its still showing huge outstandiong amount because of your finance & late fee charges. then bank increased my card limit to 7000 seven thousand but did not gave any deduction. then again i started to recieve calls for my payments & i started to make my payments as earlier. during this period i was unable to made a payment for a month then their excutives call & ask me for minimum amount due i paid after making of that payment again i recieved a call for another payment within 10 ten days of time,then again i made such amounts as per bank's excutive i do understood that was for previous month. now again i recieved a call for last month minimum amount due then i asked to tele caller executive that i m unable to make any payments in this month i will clear my minimum amount due for last month & current month togather in your coming bill. then excutive started to use very abusive language & lots of slang word during the conversation & also threatend.now what should i do in legal manner.i m unable to made a payment for current month where i m continue making minimum amount due from last 2 years almost.

I was taken a lone from M/s. Aphelion Investment & Finance Pvt. Ltd., Mulund (W) Mumbai vide my Loan Agreement dated 16.03.06, Loan A/c No.PL682/EPL0005101.

I was cleared my all installments along with Cheque Bounced charges respectively & clear the all installments, but from last more than 03 to 04 months, their representatives are harassed my family badly over the phone with a state that to pay Rs.5000/- as a last installments & cheque Bounced charges from start to end installments.

I don?t understood when I was already clear all cheque bounce charges with every monthly installments, then how this new charges was liable for me.

Even, in the last week one of lady called to my Sister & fired her with a state that if we pay Rs.5000/- to them then they will sent a legal Notice as well court summons alongwith Police authorities, we are very scared & not able to have food. My old mother & grandmother is went in very critical condition.

I may request your honour to kindly look into this matter & give me a justice

Ihad taken a topup loan on my exiting home loanfrom ICICI BANK. On the event of forecloser of the loan I was charged an amount of 2.36% on the amount of forecloser by ICICI BANK.Ihave come to understand that HDFC dose not charge such amount while any person so desires to close the loan amount.My inquiry is that ,is there any notification from RBI or any Honerabale court to this regard.

I had taken a personal loan from ge countrywide ondated20-3-07amount45100/- I gave 20 emi regular after that I want to close the loan so I gave a application but they denied. after that i stopped paymentin the bank 4 month's later on dated 4-4-06 I gave a draft of 20000/- for settlement to their agent at that time their agent not gave me any receipt when i got the recept they told that its not full & final you have 6500/- balance there is not my signature in receipt after that they gave not any informatiuon now 2 years later on datd17-5-2008I attannd a call. the person was saying that he is a DSP of mori gate his name was Raj Bir.He told me that he had a arrest warrent issue for me. He gave me a number. When I contact this no. he told me that there is a arrest warrent if u will not pay amount of 41000 with in 2 hours other wise i will pick u by police at that time I was alone i feared I told him for settlement After 1 hours he send 2 recovery agent at my home I gave him 20000/- for settlementfull after 4 days I got receipt of 10000/- when I asked him about that he told me that 10000/- is our settlement fees I complaint for this o ge money c.care they are not giving action recovery agency plz tell me what i do?

this is very good. we, the clients must be protected from such harassment. SBI Credit Card recently abused the Principal of the college where i work in Kolkata. sesveral men and women have taken turns to abuse me and my colleagues because i had refrained from paying them until they clarify the total outstanding and the high rate of interest they slapped on me, and other charges.i am alreday consulting a lawyer. to whom should i write about th harassment of several such financial institutions?

I have on OD limit A/c in HDFC bank THey are charging very high rate on retun of cheque. and Now I have plan to close the OD Limit they have putup charge of Rs39000/on the name of foreclosure of account Please let us know what is the standrad practice as RBI.

i am 60 years old lady leaving on pension of my husband my son who had taken loan on the car which was on my name for 1.27000 rs outstanding
tii today due to which i get calls from icici bank to repay my son is no more here in india and i dont have so much money to repay we both are old now and no other source of income and no help from my son as senior citizons we have no intension to be black listed in such a age where we have no helping hand i would like to request icici bank senior managers to cut short my amount as much as possible so that we can pay it at our best and live with peace we are sorry but we need ur help so that we can get rid of these harresments

If these Guidelines not followed by any bank may have to suffer Temporary Restriction or may be a Permanenet Restriction,in accordance to the Guidelines issued by R.B.I.If u want to contact this particular Person who is sacked from his House because of Illegal Means followed by CITI FINANCIAL for recovering these dues,his NAME, E mail ID and CONTACT NUMBER is mentioned above,i am his childhood Friend and knows him very well that he never had any greediness to not to pay any Loans,instead even today he is trying to repay these Loans even after not having any Financial support.I hope that this information is not misused against him rather R.B.I. should contact this individual on the grounds of Guidelines issued because i feel he should be contacted on the Grounds of Humanity because he is suffering by the ways of Citi Financial's indecent ways to collect Dues,but their are no grounds of Humanity left in India,so at least R.B.I. can follow their own Issued Guidelines.

I know the Apex Body in India is more conscious with the problems faced by citizens of INDIA.
Thats why they come up with new LAWS in regards to
Banks as well as Customers.But it is senseless and wastage of time if such LAWS are not Implemented Properly.None of the Banks follow 100% Guidelines issued by R.B.I.,it is either Because of Corruption or may be because of Lack of Ability to Implement such LAWS.R.B.I. may be conscious about problems faced by Customers while dealing with Banks,either by means of Credit Card or Personal Loans.
Fresh guidelines issued by R.B.I. for Recovery seems to fool People Verbally,Because all the clauses mentioned in it are not followed by even a single commercial bank.e.g.: Citi Financial
They have outsourced their Collection Department to Agencies which includes Local goons,who have cases in Police Stations.Even Police is not ready to take complaints against them.They dont contact a customer on his mobile number but they make a call on home numbers and abuse parents.Its a recent case of my friend who is sacked from his house because of harassment done by recovery agents.He has a Personal loan from Citi Financial from June 2004.He took top-up for almost 4 times and renewed his loan under the impression that Citi Financial is a nice Financial institution.He realised the truth when he was not on his job because of Major Health Problems from September'2007..He was never late on his Payments till September'2007.

Dear sir I had a credit card of barclaycard bank for just three month, I feel there erresponsible costomer care, wrong billing,Being tired I taked to costomer care and give full payment in one short of total outstanding and request to close the account,but again no response, they still use to send sms and bill that has no principle amount just interest and service tax.I am harrassing but donot know how to get rid of them.I shall not pay any farthing.

HDFC BANK GOONS SHOULD BE PUBLICLY HANGED FOR HARRASSING AND INTIMIDATING INNOCENT PEOPLE.
THEY DESERVE TO BE PUT BEHIND BARS.

I had converted My car loan to car
O/D.Overdraft.I got two letters from bank one shows
interest rate 19.75% and other shows 19.5%.also bank represenative not
explained me about car O.D system.I have regularly put up my cheque of
8500Rs at end of month but every time bank charged me late paymet fee.I
have aleready put CRV complaints against bank representative and stopped the payment,and asked
so many times to settel whole amount but no responce from them.The way
of talking of bank reapresentaive(mr.Sanosh-Collection dept and Mr.Uday
Kumar-Anderi barnch-Sales Manager)not good me and my wife.They are
mental harrassed both of us.

I have been harresed by HDFC COLLECTION DEPT . tHEY HAVE BLOCKED MY MONEY ( 22,000/-rS ) INSPITE OF ME PAYINMG THE SETTLEMNT AMOUNT OF 7860/- rS AGAINST 8000,RS AS SETTLEMENT AMOUNT DECIDED IN APRIL 07. tHEY HAVE BLOCKED MY Account money in 6th feb 2008 . I have spoken to the manager to spk to me .... but no manager has got back to me for the same. PLEASE HELP ME SIR ..... I HAVE LOST MY MOTHER ON THE 23RD JAN ' 08 ANF REQUIRE THE FINANCES ........

We can see RBI policies in place but with the recent incident that my family faced with HDFC credit card recovery puts us in a spot where we are not able to take action against the tele-caller and the Bank on any reason. The total outstanding payment was Rs. 25000 and the interest charges just Rs. 1200 for which we were abused, called beggars, frauds and stupid people after which she even went to the extent of calling our parents and country heads telling them that we were 'absconding'. The calls went on for nearly 6-7 hours with her calling us at least 50 times in a day. HDFC has tresspassed all standards of efficient customer service.
