A Ghaziabad court on Friday granted bail to both Krishna and Raj Kumar in the Aarushi-Hemraj murder case as the Central Bureau of Investigation failed to file chargesheet even after 90 days of their detention.
Earlier on Tuesday (Sep 9), the probe agency admitted that it did not have any concrete evidence except forensic that was not enough to file chargesheet against the accused.
The third accused Vijay Mandal was already released on bail Saturday.
It is certainly a set back to CBI which is still struggling to solve the double murder mystery, and yet to recover the murder weapons. The court accepted the defence argument that the investigating agency had nothing to prove against them and hence should be granted bail.
Krishna, compounder of Rajesh Talwar who was arrested on June 13 released on two sureties of Rs.25,000. However, CBI counsel had opposed the bail plea citing that Krishna, a citizen of Nepal could flee to his native place. Rajkumar, a domestic help was too granted bail with a same personal bond.
Aarushi, the daughter of a Noida based dentist couple Rajesh and Nupur Talwar was killed at her residence. The Noida police’s immediate suspect was the domestic help Hemraj but the case took a complete U-turn with the recovery of Hemraj’s dead body from the terrace of the same house.
The Uttar Pradesh police then held Aarushi’s father Rajesh Talwar guilty but after huge public outcry, the case was transferred to CBI. But the investigating agency has so far failed to incorporate any material evidence to book the accused for long.
