Nov 16: Orissa Government decided to restrict the quota for backward classes to 50% against the existing 65.76 % in a cabinet meeting chaired by Navin Patnaik , Chief Minister of Orissa on Thursday night.
Ts was as per the interim order of Supreme Court to restrict the quota at 50% only by this act the reservation for socially and economically backward classes would be cut down to 11.
25% from 27.45%.
But the size of reservation quota given to Scheduled Tribes and Scheduled Castes will remain same at 22.5 5 and 16.25% respectively.
The recruitment process including that of Orissa Administrative Services’ posts were hanging up since six months as the total percentage of reservation was exceeding the 50% limit.
The government after losing the case in the lower courts and Supreme Court, decided to go ahead with the recruitment process with a 50% ceiling on the reservation.
After 1994 the government enhanced the OBC quota to 27 % from 11.25%.
Supreme Court ruled that reservation can not exceed 50% limit as it would be violative of arrangements given by constitution. This ruling was accepted by all states except Tamil Nadu which give a total of 69% reservation.
Reservation is an affirmative action to bring those who are not adequately represented in the services in the mainstream and it derives its legitimacy from our constitution, recently there was a massive protest after Arjun Singh suggested extending reservation to other backward classes in government run institutions.
Since the percentage of reservation is based on the percentage of people coming under various classes as in North East states backward class range from 1% to 66% in Tamil Nadu .Hence applying 27% reservation in central educational institutions all over India deprive the chances of other sections of population of opportunities.
