Memons get interim bail from Supreme Court

New Delhi, Fri, 07 Sep 2007 NI Wire

Sept 07: The Supreme Court on Friday granted interim bail to three members of Memon family and one other who have been sentenced for life term by the TADA court for their role in 1993 Mumbai blast case.

Citing preference of Sanjay Dutt’s interim bail case, all the four convicts had pleaded for interim bail and as a result the court benched by Chief Justice K G Balakrishnan has relaxed them till they receive the judgement report from the TADA court as in the case of Sanjay Dutt.

On August 20 the apex court had approved bail to Dutt and five others on the grounds that they have not received the judgement order. But the court has ordered all of them to surrender as soon they receive the order.

The memons who got bail are Yusuf Abdul Razak Memon, Essa and Rubeena Memon and their conviction was pronounced on last Sep 12, 2006, while the final sentence was declared on July 27, 2007. However, the SC had directed them to surrender their passport to the court. The prime mastermind Tiger Memnon’s foster sister Mubina alias Baya Moosa Bhiwandiwala was sentenced for 5 years on June 14, 2007 also granted bail.

It’s been almost one year but they have not received the judgement order and taking this loophole of our justice system the SC was forced to grant bail.

As per the investigation and the end of the judgement all of the three members of Memon family were found guilty for their active involvement in the 1993 Mumbai blast conspiracy. But later the court has awarded Yusuf Memon, the youngest one of the Memon brothers to life term considering his health condition as he is suffering of brain tumor. Also Essa Memon spared from the death sentence on health grounds as she is a severe schizophrenic patient and needs regular medical treatment.
