Bihar introduces anti-corruption bill '09

The Bihar Legislative Assembly Tuesday passed the anti-corruption bill – ‘Bihar Special Court Bill, 2009’ - to counter the deep-rooted corruption from the state. The bill after its implementation will authorize the state government to confiscate disproportionate assets of the accused.


The legislation will empower the state administration to act tough in dealing with cases of corruption involving public servants on a speedy and effective basis. A special court would be set up to carry out fast trials against the accused within a pre-decided time frame.

The bill aims to eliminate corruption from the state government machineries was approved by the state legislature Tuesday by the voice vote amid some protests.

The Chief Minister Nitish Kumar, on debating over the issue of corruption among the public servants, said that the state government has launched a war against the corruption and hoped that the Centre would not intervene in sanctioning the bill as it was a central one.

This bill will be only effective on the state government, including retired employees, he added.

The existing laws are “insufficient” for nailing corrupt bureaucrats and ministers while the new bill would empower the tooth and nail to deal with the government or retired officers and employees, he said.

On the need to introduce this clutching bill, Nitish said he was well aware about the deeply rooted corruption in the government system and also about the public fury against this ‘disgusting’ disease.

During his vikas yatra (development march) organised in January-February in the rural area, Nitish came to know that corruption was a big hurdle in the development of the state and people were keen to fight against corruption that motivated him to introduce the anti-corruption bill so soon.

This bill would now empower the state government to confiscate assets of government officials against whom cases of possessing disproportionate assets have been filed and chargesheets have been submitted in the court of law.

The trial of the case would begin in the special court within 30 days of filing the chargesheet under fast track trial system and the case would be finalised within six months time limit, said CM.

Besides, anti-corruption bill, two more bills - Bihar Fiscal Responsibility & Budget Management (Amendment) Bill, 2009, and Bihar Cooperative Society Amendment Bill, 2009 – were passed by the Lower House of Bihar assembly on Tuesday.
