Some Allahabad HC judges may face transfer in PF scam: Chief Justice Balakrishnan

New Delhi, Jan.18 (ANI): Chief Justice of India K.G. Balakrishnan has stated that some judges of the Allahabad High Court are proposed to be transferred in connection with the Ghaziabad provident fund scam. But no final decision could be made in the case as yet.

 

"The CBI has made some preliminary inquiries. So we propose to transfer some judges. But no decision has been taken to transfer them," the Chief Justice Balakrishnan said.

 

Though the Chief Justice denied suggestions that the cumbersome process of impeachment had deterred judiciary from taking tough action against judges of the higher courts.

 

"As regards removal of judges, these are all constitutional provisions. We can't change them unless the Constitution is amended. The removal of judges by impeachment is the only provision by which a judge can be removed".

 

"That is purposely made a little difficult and cumbersome. Otherwise, everyone will make a complaint against a judge and he will be subjected to all sorts of harassment," he said talking to media.

 

Chief Justice Balakrishnan set in motion the process of action against judges with questionable conduct. But, presently, he is waiting "further explanation" from a judge of the Punjab and Haryana High Court in the infamous cash-at-judge door scam before taking any further decision in this regard.

 

When asked about proceedings in a previous case that involved Justice Soumitra Sen of the Calcutta High Court against whom he had recommended impeachment for alleged financial misconduct before being elevated to the High Court, the Chief Justice Balakrishnan clarified that in that case he took the step after Sen had refused to submit his resignation.
