New Delhi, Nov 11 (IANS) The Bharatiya Janata Party's (BJP) chief ministerial candidate for Delhi elections V.K. Malhotra Tuesday replied to the Election Commission's (EC) notice explaining that he did not violate any norms while filling his nomination.
According to the Election Commission guideline the maximum number of vehicles allowed to come within the periphery of 100 meters of the returning officer's chamber is three. The maximum number of persons allowed in at the time of filing nomination is the candidate and four others.
EC Monday issued a notice to Malhotra for violating these instructions.
Malhotra filed his nomination from the Greater Kailash assembly seat Saturday afternoon at Jamnagar House on Shahjahan road.
Malhotra was asked to furnish an explanation by Tuesday evening as to why action should not be taken against him for the violation of the commission's instructions.
'We filed the reply to the EC Tuesday afternoon at around 2:30 p.m. We have explained to the commission that V.K. Malhotra went to the returning officer's office in his car with his wife and Delhi BJP chief Harsh Vardhan only,' Delhi BJP legal cell head Hari Om Gupta told IANS.
'There was no other car with Malhotraji. We explained to the EC that supporters were present at the place before he reached the Jamnagar House,' Gupta said.
According to Gupta, the explanation given to the EC by Malhotra says: 'When I entered the returning officer's room, accompanied by my wife and Dr Harsha Vardhan, the returning office never asked others including senior leaders to go out. A simple request or an announcement to this effect would have sufficed. As a candidate, I could not be expected to start regulating people present there.'
The commission had also ordered the immediate transfer of Greater Kailash Returning Officer Bans Raj Ram, Assistant Commissioner of Police (ACP) Puspender Kumar and Sub Inspector K.L. Yadav for failure to implement the commission's orders.
