SC rejects plea of Apollo docs in Rahul Mahajan case
The Supreme Court of India on Monday (May 05) rejected the Delhi's Apollo hospital doctors’ plea for not facing the trial in Rahul Mahajan drug abuse case as they have alleged, “Delhi Police had unfairly framed the charges.”
Hearing the appeal of six Apollo doctors to prevent them from quashing in the court, the Chief Justice of India, who was leading the hearing bench has rejected the docs’ plea by citing that it was not in the favour of Delhi police who have charged them for destructing the crucial evidence in Rahul Mahajan drug abuse case in 2006.

Delhi Police has on October 2006 had filed charge sheet before the metropolitan magistrate against 12 persons including six doctors Anupam Sibal, Abha Gupta, Awdhesh Bansal, Ali Muhammed Ganai, Prasad Rao and Mukund Pandey and executives of Apollo Hospital by framing the charges of tarnishing evidence, protecting the culprit by misleading the investigating agencies by providing wrong information under Section 193 and 177 of IPC.
Besides, Delhi Police had also charged Apollo DGM Rajji Chandru and Pramod Mahajan’s friend and assistant Sudhanshu Mittal for giving special instruction intentionally to tamper the hospital register in which the actual time of admission of Rahul Mahajan and Bibek Moitra, Pramod Mahajan’s secretary was marked.
Both, Rahul and Bibek were taken in to the hospital on June 03, 2006 in a very serious condition. The doctors of Apollo hospital had declared Bibek brought dead while Rahul was admitted in ICU, but later transferred to AIIMS after police intervenititon.
The Apollo Hospital has ill-informed the police that no symptoms of drugs were found in the blood and urine samples of Rahul and Bibek, while the Central Forensic Sciences Laboratory had claimed to found the traces of heroin and cocaine in the blood samples of Rahul and Moitra.
On that basis, Delhi police had booked 12 people including Rahul Mahajan, Rajji Chandru, Sudhansu Mittal, Sahil Zarru, (the alleged cocaine provider), six doctors and two other.
Earlier, last year, Delhi High court had also rejected the plea of the doctors for protecting them from trial.
On the other hand, Delhi Police has claimed that it has strong evidence to prove the accused guilty.
