HC reflects 'no confidence' in Kerala police, calls for central force

First the Kannur bloodshed led to the violence that incurred at the CPM headquarters in capital city on Sunday by the alleged BJP workers and its reverberation rocked both the houses in Parliament later and now the Kerala High Court on Tuesday proposed permanent deployment of central forces in Kannur district to protect lives of innocent citizens.

The Kerala High Court, while observing that manslaughter had become a day’s order under the Left’s rule in the state, said the only solution to curb the violence in Kannur district could be achieved through Centre’s timely intervention by deploying sufficient forces, as these forces would not yield to political or plutocratic clout.

“Gubernatorial move to apprise the Central Government of the urgent need for a permanent prophylactic action to curb further bloodshed and killings in Kannur District where manslaughter is a competing sport.”

To bring violence under effective control, justice V Ramkumar expressed the hope that there would and should be a move at the intervention of the governor to apprise the Central Government of the urgent need for a permanent prophylactic action to curb further bloodshed and killings in Kannur District where manslaughter had converted into a competing sport.

The Court made these observations while listening on the petition filed by Mariyu in which she said that her husband was assassinated by CPI (M) activists owing to his desertion from the party.

After hearing the petition, the Court handed over the case to the CBI of Mohammad Fazal, a newspaper vendor of ‘Thejus’ and supporter of a Muslim outfit—National Democratic Front—who was killed in October 2006 in Thalassery.

The judge observed that the State police were “par excellence in crime detention and investigation,” provided there was no political or other intervention. But the ground reality was that there was a different picture in Kannur.

The court observed a shame on democratic institution when police under political influence are shielding those, who are really guilty and sending innocent persons behind the bar. These innocent persons are those, who either listed out from the party office or the volunteers ready to sacrifice for the party at the party’s expenses.

High Court’s direction

The CBCID of Thalassery earlier informed the court that no one had been arrested in the case and the investigative team did not find any clue regarding the assailant.

The High Court then on March 10, 2006 entrusted the investigation to a Special Investigation Team (SIT) headed by the Superintendent of Police. The SP (Crime branch) of Kozhikode filed a statement stating that three CPM activists, “who are known goondas”, had been arrested.

The court said that no investigation seemed to have been conducted to pinpoint and confirm the identity of the accused. The court had directed the SIT to resort to scientific analysis comprising DNA tests and Polygraph tests to unravel the truth, if it was not able to find the clue.

It had also directed the SIT to inquire into the role of IAS/IPS officers in various matters relating to the Divine Retreat Centre, run by Christian priests at Muringoor in Thrissur district including publication of in-house magazines.

Supreme Court’s intervention

On Tuesday, the Supreme Court quashed the Kerala High Court order in relation to probe of the state police into various allegations against the 'Divine Retreat Centre' by a Special Investigation Team (SIT).

A Bench comprising Justices S H Kapadia and B Sudershan Reddey directed that the investigation be carried out by the Kerala Police, which will submit a report on the probe conducted so far to a magistrate.
