In a historical decision, today the Supreme Court rejected a petition seeking to ban Sharia courts, however it stressed that they have no legal powers over Muslims and their decisions cannot be enforced. Apex court made it clear that the Islamic judges certainly who interpret religious law, can rule only when individuals submit voluntarily to them and their fatwa or the decisions are not legally binding, as the court mentioned.
Court also quoted that the Sharia courts are not sanctioned by law and it has nothing to do with the legality in the country. Judge also said that no religion can be allowed to curb anybody’s fundamental right in the country.
It is noted that India's 150 million or 15 crore Muslims follow their own laws governing family life and other personal issues such as marriage and divorce as the Sharia courts used to rule on such matters and mediate in disagreements. It plays crucial role in this matter.
