Delhi HC agrees to hear plea against Kejriwal

New Delhi, May 26 (IANS) A petition was filed Monday in the Delhi High Court here seeking action against former chief minister Arvind Kejriwal for writing an open letter to his supporters from the Tihar Jail.

Aam Admi Party chief Kejriwal is currently lodged in the Tihar Central Jail as he refused to furnish a bail bond in connection with a defamation case. He May 24 wrote the letter explaining circumstances behind him being in jail.

Advocate Vivek Narayan Sharma mentioned the matter before a division bench of Justice B.D. Ahmed and Justice Sidharth Mridul, requesting it to direct the centre to block the website of AAP until open letter of Kejriwal is withdrawn from its website.

The court posted the matter for Wednesday.

The petition stated that after a trial court sent Kejriwal to judicial custody, he instead of challenging that order chose to instigate people "to follow no rule of law and put baseless and deemed allegations against judiciary".

"Kejriwal showed gravely defamatory and contemptuous conduct by issuing open letter from Tihar Jail," the plea said.

The letter was circulated by the AAP office bearers to public at large, various media and was also uploaded on AAP website, the petition said, seeking direction to the centre to take suitable steps to stop publication and circulation of the letter.

The letter is "dangerous for society and intended to create atmosphere against rule of law and courts", advocate Sharma said.

"The centre (home ministry) to initiate suitable legal action as per law against publication and circulation of open letter of Kejriwal or other similar matter to defame and show contempt of courts for inciting people to follow no rule of law, for asking people to release Kejriwal without rule of law and various other offences committed by him and AAP and their office bearer and members," plea said.

The AAP has not only loaded the letter on its website but also circulated it over all the social media like Facebook and Whatsapp. The party is also circulating this letter in printed form to public, and plan to circulate to every house in Delhi and the National Capital Region in the coming week, said the lawyer.

In the letter, Kejriwal asked people to secure his release, which shows that "he is instigating, inciting and provoking his followers to fight and create social unrest against rule of law", and seeking his release not through an appeal but by way of "anarchy and disorder", the petition said.
