The Delhi High Court Wednesday adjourned the hearing on the death penalty awarded to four convicts by lower court and set the next hearing date on October 01, 2013.
However, a day ago, Delhi HC on Tuesday said that the hearing procedure will begin from Wednesday on day-to-day basis as Delhi HC has to pronounce its verdict within one month from the beginning of the hearing of the case.
Deferring the hearing, a bench of two judges - Reva Khetrapal and Pratibha Rani, Wednesday asked from the prosecution to provide copy of the trial court's verdict and other documents to the respondents in the case to the high court.
In this response, the defence lawyers informed the bench that they have not been provided with the set of documents either by the court's Registry or by the prosecution on a court's query whether they have received the paper books to start the arguments.
Special Public Prosecutor Dayan Krishnan agreed to supply the complete paper books to the defence within two days.
The court also asked the Registry of High Court to furnish a translation of the victim's dying declaration in English and relevant statements of witnesses.
The trial court Sep 13 awarded death sentence to Mukesh (26), Akshay Thakur (28), Pawan Gupta (19) and Vinay Sharma (20) and referred the case to the high court for confirmation of the sentence.
On Dec 16, 2012, a 23-year-old woman was brutally gang-raped in a bus by six people, including a juvenile. She died of her grave intestinal injuries Dec 29.
Of the six accused, the juvenile has been sent to a remand home for three years, the maximum sentence permissible under the law. One accused was found dead in Delhi's Tihar Jail.
