Kochi, May 29 (IANS) The Kerala High Court Tuesday dismissed the pleas of two Italian Marines to quash the first information report filed against them by Kerala Police in the Feb 15 fishermen shooting case.
A similar plea by the consulate general of Italy was also rejected.
Two Indian fishermen were allegedly mistaken as pirates and shot dead off Alappuzha in Kerala by Marines Latorre Massimillano and Salvatore Girone, who were serving as the security crew aboard cargo vessel Enrica Lexie.
Justice P.S. Gopinathan while dismissing the petitions noted that police registered the case in a proper manner and the Italians did not have any special rights or privileges.
Police last week filed a 196-page charge sheet naming the two arrested marines as the accused in the killing of the fishermen.
The judge asked the Italian marines to pay Rs.1 lakh as expenses and also asked the families of the two killed fishermen to pay Rs.10,000 each because they had first impleaded in the case and then withdrawn their petition after collecting a compensation from the Italian government.
The two marines were first sentenced by a court in Kollam for 14 days custody Feb 20. Last week, they were shifted from a prison in Thiruvananthapuram to a Borstal School near here.
