Pravin to serve life term

Dec 18:  The Mumbai Session Court on Tuesday awarded life term to Pravin Mahajan for killing his brother and leader of Bharatiya Janta Party (BJP) Pramod Mahajan. Under IPC section 302, the court has also imposed a fine of Rs 15,000 on him for the murder.

 


The court earlier on Monday held him guilty of intruding the BJP leader’s house with intent to murder. There was sufficient evident against Pravin and hence the rigorous punishment. The court also observed Pravin’s past history before pronouncing the quantum of punishment that spared him from getting death sentence.


The prosecution had demanded the death penalty but the court didn’t term it as the 'rarest of rare' case and so avoid capital punishment. However, the prosecution said that they would appeal for highest punishment, death penalty.


The court also announced an additional punishment under section 449 and awarded five years along with Rs 10,000 for house trespassing and with an intent of a serious crime. Both the terms will run simultaneously.


That Day – April 22, 2006


On April 22, 2006, Pravin (48) went to the Worli residence of his brother Pramod and as the investigation reports, Pravin after some argument with Pramod shoot three times with a licensed revolver and soon after left the place and surrendered himself before the Worli police.


Pramod Mahajan was soon sent to the hospital but after 12 days of doctor’s effort he died at a city hospital on May 03, 2006.


On Tuesday’s verdict the court refutes the argument of the defence that it was an accidental firing following a scuffle between the brothers. The court also denied the alleged SMS sent by Pravin to Pramod was fabricated.


The SMS reads as: "Now there will not be any plea or prayer, now there will be a confrontation".


In defence’s argument Pravin’s wife Sarangi told that she had sent the SMS to Pramod with a different text which had been tampered. But the court rejected her witness.


"We will definitely try for an enhancement of punishment. We have not yet read the detailed reasoning, after that we will decide on the next step," said Chief Public Prosecutor Ujjwal Nikam, adding "A motiveless crime is more dangerous than motivated crime - a motive means there is some justification for the accused for committing such a crime."


Though Pravin’s wife didn’t utter a single word after the judgment, her brother revealed that they will approach the door of High Court.
