SC refers OBC reservation issue to a larger constitution bench
May 17: The apex court said today that the government can not take any bulling attitude that deals with the fundamental rights of the citizens. It has now referred the most talked about OBC quota issue to a larger constitutional bench.
The 27 per cent OBC reservation in elite educational institutes has raised several questions on this caste based reservation and hence the court referred it to a larger bench.

Citing its constitutional importance and rights of the citizen as a whole, the Chief Justice K.G.Balakrishnan preferred for a better analysis by constituting a committee who would examine the 93rd amendment of the constitution, which gives power to the government for providing reservations for backward classes in the society.
However, the members of the committee will be selected by the Chief Justice who has to look into several aspects of this reservation issue. The issues of considerable importance are the criteria for determining backwardness, whether it would be based on socio-educational basis or should it be based on socio-economic, and should the creamy layer in OBC be included on the reservation or not?
Earlier the Supreme Court has rejected any such reservation policy of the government keeping in mind a larger interest of the people. But later it agreed to hear the case again and reject governmentâ??s pressure to implement it from this academic year.
However, the Other Backward Class OBC, of the society has to at least wait another year for its implementation. Meanwhile, after the formulation of a larger bench all concerned questions from both parties will be discussed and then only the confusion cleared as whether it is going to be implemented in the next year or not.
