Indian national files contempt plea against Malay immigration officer, ex-boss

Kuala Lumpur, Sept.12 (ANI): An Indian national, who is serving a sentence for overstaying in Malaysia, has filed an application for contempt of court against an Immigration Department officer and his former employer.Forty-six-year-old K. Sathiyamoorthy filed the application in the Industrial Court registry on Thursday with the assistance of Malaysian Trades Union Congress industrial relations officer A. Balasubramaniam.

 

Under the Industrial Relations Act 1967, anyone found guilty of contempt can be fined up to RM100. If the fine is not paid, the offender can be jailed up to one month.

 

In his application, Sathiyamoorthy urged the court to issue show-cause letters against the Immigration officer, his ex-employer TG Medical Sdn Bhd and the company's legal manager Manmeet Singh as to why they should not be cited for contempt.

 

Sathiyamoorthy, who is serving a 10-month jail term at the Kajang Prison, said he was arrested in the vicinity of the Industrial Court by Immigration authorities at 2.15 p.m. on August 6.

 

The New Strait Times quoted him as saying that Manmeet, who was representing TG Medical, brought several Immigration enforcement officers and pointed him to them. He said he tried to explain that he was there to attend a court hearing by producing documents but to no avail.

 

He was arrested, taken to an Immigration depot and later sent to prison after he pleaded guilty to the offence.

 

Claiming his ex-employer had withheld his travel document, Sathiyamoorthy said he regretted that his ex-employer, Manmeet and the authorities deliberately made sure that he did not attend court.

 

He said Balasubramaniam, who was representing him in the unfair dismissal case, later told him that Manmeet had applied to the court to strike out his claim.

 

Attempts by Industrial Court chairman Yamuna Menon to get Sathiyamoorthy and TG Medical, represented by S. Selvan, to settle the case out of court ended in a deadlock.

 

Yamuna fixed another mention on September 23 in the hope that both parties could come to an agreement. If they do not, the trial will begin on October 23. (ANI)
