CBI fails to file chargesheet in Aarushi case

Failing to muster corroborative evidence in the Aarushi Talwar's murder case, the Central Bureau of Investigation said on Tuesday that it was not able to file chargesheet against the accused with the lack of enough evidence. However, it said the investigation would continue.

During a press conference held at CBI headquarters, a CBI official said, “We have conducted some scientific tests during our investigation. But, we are still trying to recover the missing mobile phones and the murder weapon.”

CBI said Section 167 of the CrPC grants right to every person in custody to be released on bail if no chargesheet is filed against him within 90 days of the custody.

CBI said that a chargesheet will be filed only when it completes its investigation into the case. This disclosure is significant, as today is the last day for CBI to present its case in the court and press for charges against the three accused—Krishna, Rajkumar and Vijay Mandal.

The under pressure CBI also announced that a reward of Rs 1 lakh would be given to anyone who gives a clue regarding Noida double murder case—murder weapon, mobile phones of Aarushi as well as the domestic help, Hemraj.

CBI also expressed doubt that the weapon used in the murder could be a sharp-edged Khukri and might be hidden in Nepal. The officials said the Agency would seek help from the government of Nepal in an attempt to disclose the murder mystery.

A week ago Vijay Mandal was released on bail. Now the fresh announcement on the part of CBI, which is not going to file chargesheet since the accumulation of evidences, might prompt other duo suspects to seek bail.

The CBI official, however, said when the bail application would come up in the court, the full facts of the case will be presented before the court in a truthful, legal and professional manner.

The murder case took the whole nation into a state of shock, when a 14-year-old school girl Aarushi was found dead in her bedroom in the morning of May 16. The needle of suspicion initially stuck at the domestic help, Hemraj, but, reverted back when a day later the Noida police recovered his body from the terrace of the same flat.

Later the Noida police without any evidence and thorough examination arrested Dr. Rajesh Talwar in the murder of his own daughter and the domestic help simply on the basis of statement of today's prime accused Krishna, compounder of Dr. Rajesh Talwar. The Noida police with the arrest of Dr. Talwar had said the case was over.

It was then owing to pressure from all quarters that the case was then handed over to the CBI, which did not find any evidence against Dr. Talwar leading to his release in July.

The other three accused-Krishna arrested on June 13, Rajkumar, arrested on June 26, and Vijay Mandal on July 11-remained in jail as CBI in its investigation found them the prime accused.

Among the three, Vijay Mandal was released on bail last week. Today was the final day for the CBI to file the chargesheet as according to Indian Penal Code, an accused could not be detained further after three months if chargesheet was not filed against him on/within the said period.
