Mayawati government brings â??UP Organised Crime Control Bill 2007â??

Nov 01: Mayawati government on the lines of Maharashtra government has tabled ‘Uttar Pradesh Control of Mafia (Organised Crime) bill 2007 to bring all white collared criminals who are not nailed under existing laws to book.

How tough legislation is can be gauged from the fact that organised crime includes even copying in the exams and those providing patronage or logistical support to such crimes can be behind the bars for a minimum period of five years.

 

Apart from this maximum punishment has been capital punishment apart from life imprisonment and fine of Rs. 1 lakh. And once registered under the act the criminal would not be able to get ex-parte bail and registration of the case second time would render the crime unbailable.


Organised crimes


Net of the organised crime has widened so as to take in its fold not only terrorist activities, kidnapping, land grabbing by force or false documents, contract killings but also money laundering, gambling, flesh trade, human trafficking, manufacturing or supply of spurious drugs.


Even copying in the examinations, display of firearms at public places will be considered as organised crime


Bill envisages a nexus between organised crime syndicates and terrorists outfits and such elements active in the state.


Organised crime control authority


A state organised crime control authority will be set up headed by principal home secretary with members Additional Director General of police, Inspector general of crime branch.


Apart from this every district will have organised crime control committee, which will be chaired by the DM with the district police chief and others as its members.


Special courts


There is provision of formation of special courts by the state government in the bill to try such cases after consultation with the high court of the state. For them special public prosecutor will also be appointed. Court will have day-to-day hearings without any adjournments but for special conditions.


Apart from the courts an appellate authority headed by a retired judge of high court will be set up in the state.



To prevent its misuse there are certain checks too. No FIR can be filed under the act without the written permission of the DIG and Divisional Commissioner and permission in black and white is mandatory for bringing charge sheet in the court of law.


Bill is being seen as a control mechanism for bridling tainted representatives of the state and effective tool to check mafia activities.
